DHCD's Sarah O'Leary sent the following notice on Monday confirming that DOR views housing authorities and their employees as exempt from the new Paid Family and Medical Leave law:
With respect to the applicability of the new Paid Family and Medical Leave law in Massachusetts, the Department of Family and Medical Leave has informed DHCD “their view is that the Housing Authorities and their employees would be exempt under 175M.”
October 1, 2019 is the day payroll contributions will begin for the Massachusetts Paid Family Medical Leave Act. In preparation for the implementation of this law, DHCD has heard that some LHAs are receiving information from their payroll providers that they must begin withholding in accordance with the law.
If you have received communication from DOR that your LHA is “Auto Registered for Paid Family and Medical Leave Account”, we suggest you submit an email through Mass Tax Connect to clarify your LHAs status (https://mtc.dor.state.ma.us/mtc). You may also have to work with your payroll provider to clarify your LHA’s status. You may provide this email to clarify the Department of Family and Medical Leave’s view regarding LHA exemption from mandatory withholding.
