On August 15th, the Executive Office of Housing and Livable Communities (“EOHLC”), released proposed regulation 760 CMR 75.00 – Life Cycle Assessments of State-Funded Housing. This proposed regulation was in response to requirements set forth under St. 2024, c. 239, §113. Under this proposed regulation, as a condition for EOHLC funding, State-Funded Housing projects funded after July 1, 2026, will be required to undergo a Life-Cycle Assessment prior to the commencement of construction activity. State-Funded Housing Projects are defined as “major redevelopment, repair, renovation, or new construction of State-Funded Housing.” State-Funded Housing is narrowly defined to only include public housing. Ensuring that public housing is environmentally conscious is important. However, based on MassNAHRO’s reading of these proposed regulations, there would be a significant financial burden placed upon local housing authorities. MassNAHRO submitted public comment last week addressing those concerns and urging EOHLC to bring impacted parties to the table to create a system that comports with the statute while not placing additional burdens on local housing authorities.
